| Sherwood Forest Road Maintenance District Prudential Committee Meeting Minutes May 6, 2006 Committee Members Present: Richard Tallberg, Chairman; David Bonney, Robert Ronzio, Jerry Summit, Mike McEnerney Staff Present: Chuck Andrews: Road Superintendent Public Present: See sign in sheet. Reading of the Minutes: The minutes of the April 1 meeting presented to all present, motion to approve by Bob Ronzio, second by Jerry Summit. Motion Passed. Treasurers Report: The Treasurers report is the same as the March meeting report due to the current vacant treasurer's position. Based on communications from the Town, no funds have been turned over pending the appointment of a new treasurer. Motion to approve the report by Dave Bonney, second by Bob Ronzio, no discussion, report approved. Reading of the Warrant: Due to lack of a Treasurer, no warrant was prepared, current bills will be discussed under "Communications". Road Superintendent's Report: Mr Andrews reports that the spring grading has started. Nothing else to report at this time. Motion to approve by Bob Ronzio, second by Dave Bonney, no discussion, road report approved. PUBLIC PARTICIPATION Ron Boucher-Would like a review of the contract rejected by Whitewolf, and a copy of the letter from the lawyer saying that it was illegal. Ed Jekot- Culvert on Prince John Rd in front of his house has been moved affecting his wellhead, trees and poles, they are being undermined. Also on Nottingham Circle at his property, he would like a culvert moved. Mr Jekot would like to know the permit process for road work permits. Dick Tallberg- In reply, the Town of Becket gives permits and inspects. Ed Jekot- Questions "Title 20" status, he would like the boulders moved, grading changed and culverts addressed. Chuck Andrews- In reply, he has received several calls with a return number of Mr Jekot' Becket phone number and has not been able to contact him. Additional discussion between Mr Jekot and Mr Andrews about culverts on Prince John and damage from October 8 storm. Robert Ronzio- In reply to Mr Jekot, culvert scraps on Prince John that are SFRD will be cleaned up, those that are driveway culverts are private property and for the property owner to dispose of. SFRD will also look into the Nottingham Circle Question. James Griffin- Concerning the Sykes property and flooding conditions on Forster property. Mr Griffin has photos and would like to present them. Mr Tallberg requests that they be held until the meeting end. David Bonney- Someone dammed up the culvert on Alan-A-Dale at Sykes location. Lyle Forster- Presents a description of Sykes moving his culvert three times over the past three years doing damage to his property now. Bill Brownhill- This Sykes problem is in litigation and we cannot discuss it. Murielle Forster- Claims it is not in litigation, this ditch and culvert were moved December 5, 2005 Discussion on the status of letter to Road District attorney on this matter. Dick has a draft of the letter and reads a portion of it. Robert Madore- Would like a copy of the letter, Dick claims that we need to check with the former Clerk to see if the signed copy was ever sent. Additional discussion on DEP and this site, Conservation Commission records. Robert Ronzio would like a letter sent to Mr Sykes to appear a Road District meeting with the Conservation Commission documents. Chuck Andrews- Concerning Sykes property, there were two culverts of 12 inch diameter at one time. Ron Boucher- Questions why the road contract has not yet gone out to bid. This is not fair to the tax payers, we are not getting the best deal. Also we could "piggyback" with the town, he has presented it before, to date the town has not been asked. Robert Ronzio- Would like a motion to send Mr Sykes a letter requesting documentation, also to send a letter to the Conservation Commission requesting pertinent documents. Ron Boucher- Would like a copy of the audit, Mr Tallberg replies that we do not have it yet. COMMUNICATIONS Letter from Mass. DEP concerning 134 Little John Drive , Chuck Andrews will attend a May 18 meeting on this and respond to the Prudential Committee at the June meeting. Letter from Maryellen Lake on 2005 flood payment MEMA, there is an additional state share of $6,500 to be sent to SFRD. Letter from Maryellen, thanking those who moved the Road District files and equipment out of her home. Letter from Maryellen concerning bonding. Letter from Town of Becket advising that a new treasurer needs to be appointed before funds can be released. Letter from Berkshire Bank concerning SFRD account. Close under Communications, further discussion on replacement for Clerk Treasurer, no one can sign checks at this time. Dave- We still need a warrant. OLD BUSINESS Workmens Comp, Dick signed and sent the form back, we need to locate this copy. Letters of appreciation from Prudential Committee to Bill Brownhill and Maryellen were signed by Dick and given to Bill. Building Committee Report: Nothing to report at this time. Bob advises that Chuck has a construction trailer on his property at this time. Bob asked if the road district could set up a trailer at an Andrews site also. Trailer rental cost is $210 per month and it has heat and AC. It is registered. Beaver Storage, Bob and Jerry Summit have the keys. NEW BUSINESS Jerry Summit questioned the current condition of the roads. Chuck advises that we are on schedule with an early spring. Chuck asks if we want work to continue? Discussion between Mr Jekot and Mr Ronzio concerning bonding and checks and the signature cards at Berkshire Bank. Question concerning Whitewolf storage of material in Sherwood Forest. This was on Andre LeDoux property, in a private deal with Whitewolf, it is not Road District material or property. Mr Griffin presents his Power Point presentation of photos of the Sykes and Forster properties. After viewing photos, Mr Ronzio makes a motion that the Prudential Committee send a letter to the Conservation Commission requesting that the activity in front of Mr Sykes property "cease and desist" on Road District right of way. The motion was seconded by Mr Tallberg and approved by all. Chuck will sigh this letter and bring it to the Conservation Commission meeting on Monday May 8.
