| SHERWOOD FOREST ROAD MAINTENANCE DISTRICT Prudential Committee Meeting January 21, 2006 Committee Members Present: Richaard Tallberg, Chairman; Bill Brownhill, Vice Chairman; Robert Ronzio, David Bonney Staff Present: Charles Andrews, Road Superintendent; Maryellen Lake, Clerk/Treasurer Public: See sign-in sheet The meeting was called to order at 10:40 a.m. Reading of the Minutes: The minutes of the January 7, 2006 meeting were distributed and read. Bob moved to accept the minutes as presented; Bill seconded; motion passed. Treasurer's Report: Maryellen read the Treasurer's Report. Bill moved to accept the Treasurer's Report; Dick seconded; motion passed. PUBLIC PARTICIPATION It was noted that the snow in front of the mail boxes had been cleared. Jim Griffin brought up the problem with the Sykes and Forster issue. There ensued a very lengthy discussion of the problem during which the following points were discussed: 1. Maryellen asked for clarification of the contents of the letter to be written to Mr. Sykes. Bob noted that before anything can be done we should get the plan and other information from the Conservation Commission. 2. Jim described how the problem arose due to actions taken by Mr. Sykes. He asked in behalf of the Forsters that the pipe be put back where it was before it was moved on December 3. He asked the Committee for a solution to the problem. Dick announced that this issue will be moved to Old Business 3. Chuck noted that the solution involves moving the pipe north and running it down between the road going out to the dam and the one going out to the beach. 4. Mr. Mador described conditions with excessive water in the road near his property. He asked if he could dig a trench on his property, install pipes and a culvert without the approval of the committee. Dick said we can't give him approval. The point was made that in the past no one has ever given approval for that. 5. Dick made the point that there never has been a plan for all of the culverts in the Forest, so there is no legal recourse because you don't know where the culvert is supposed to be or who moved it. There is nothing on file with the town. 6. Bob: We have the authority to move the pipe because it's on Road District property. We do not have the authority to move it back to Mr. Sykes' property. Dick closed Public Participation. Communications: E-mail from Mr. Simiawski; e-mail from Jekot; Certificate of liability insurance from Andrews Excavating; letter from auditor approving opening new checking account. Road Superintendent's Report: Chuck noted that we had lots of snow and rain and mud has made the roads a mess. Bob asked Chuck to estimate mud season. Chuck doesn't anticipate much, since there are only a couple of inches of frost so far. OLD BUSINESS Sykes issue: another very lengthy discussion among Committee members, Messrs, Griffin, Mador and Lerner, continuing with the following points: 1. Bob called for Mr. Sykes to produce his documentation., noting that he does not believe Mr. Sykes had the authority to move the culvert without Board approval. 2. Chuck: When the Road District was created in 1982, it was already set in the plans, through vie Superintendents, that the drainage culverts crossing under all the roads in Sherwood Forest could not be altered or changed or directed anywhere else. 3. There appeared to be agreement among the Committee members that it's the Road District's problem up to the edge of the road. Bill cited the Morrow property issue on King Richard and the solution to that problem. 4. Mr. Sykes presented his documentation and showed his plan to the Committee. He used the plan and an order issued by the Conservation Commission on June 26, 2002 to explain his position. He gave the Committee a detailed history of his activities, based on his original documentation. He noted that the plan he was presenting is for a septic design. Although Mr. Sykes cited a letter from an environmental scientist which made changes to the plan, Bob made the point that the changes noted on the plan were never initialled by anyone. Mr. Sykes noted that the town Conservation Commission records are missing from their files. 5. Bob made the point that the whole Forest needs to be mapped and surveyed. 6. Dick asked Chuck for a basic plan to correct the situation, together with an approximate cost estimate so that, if we have to we will front the mondy. After much further discussion regarding Mr. Sykes' responsibility and that of the Road District, Chuck will consult with the Conservation Commission and report back at the next meeting.\ 7. Mr. Madore asked for advice on what would be required of him to make changes to get rid of excessive water on his road and what cost the District would be willing to pay. Dick said that he doesn't know until he knows what the costs are and if it's the Road District's responsibility. Dick: "If it's a problem that we have to correct, then we will come up with some funding. If it's not a problem that we have to correct, then we won't." Further discussion with Mr. Mador regarding the problem near his property which should be addressed. He expressed willingness to get the necessary plans and go to the Conservation Commission. 8. Chuck will submit a plan to correct the Sykes issue in the form of a recommendation. 9. Jim Griffin asked for copies of the tapes of this meeting and the meeting of January 7, 2006. They will be supplied.at his expense. 10. Chuck expressed the opinion that the Road District has gone too far with this issue. The simple problem is that there is a violation on Road District property. Contract: Since it is so late in the year, this item was tabled. Audit: The auditor is wrapping up now. He's got other clients and apologized for the lateness of the final report and will probably have it for us by the next meeting. Spoja letter: The Spoja letter - listening to the tape there was supposed to be some kind of change made in that letter and I can't figure out what. Maryellen asked for advice on any addition to the letter she has already written but not sent. No advice was given. FEMA report: Maryellen are scheduled to meet with Mike Cullivan from FEMA on Wednesday. She will ask Blanche to help her in outlining the projects and determining costs. Bob: asked if FEMA is going to meet with the Road Superintendent. Maryellen noted that may be next Wednesday. Stuffer: New text. Discussion. Bob moved to approve tax bill stuffer, Dave seconded; motion passed. Warrant for special meeting was signed and five copies were given to Chuck to post today. Annual Meeting : Change of time due to conflict - item tabled The Committee signed Warrant #9 in the amount of $12,9029.14 and Warrant #9A in the amount of $27,615.00. Dick moved to pay the bills; Bill seconded; motion passed. There being no further business to come before the meeting, Bill moved to adjourn; motion was seconded and passed.
